WARNING SIGN!!!!!Dear people who care and concern about the rights of our Indigenous Peoples in Sarawak please take note that these ‘HANTU PEMUSNAH’ might go again to the ground tomorrow(27/01/2010) or the next day to demolish more houses.

Please do take note on this TOPIC when people like YBs or someone from the government departments or event journalists define NCR and temuda land differently and confusingly. Many of our YBs are confused lots and no ‘balls’ to speak the truth. The companies and their agents are trying to confuse the Sarawakians especially the DAYAK themselves and what more to say the ourside world.

1. NCR (Tanah Adat) means Native Customary Right that comprises a territory of a particular longhouse which they claimed through their respective adat called ‘panggul menua’(Iban) or ‘Adet Puun’(Kenyah)’ before1.1.1958. All the Natives of Sarawak have their respective ADAT on land and their territory. Our Court has confirmed this ADAT but someone still disagreed because they don’t understand our Adat. It means they are imposing their adat on us. So this means that whatever the folks of a particular longhouse do to their land(before or after 1.1.1958) and that is their NATURAL and ADAT’s rights. Thus the temuda (farm land) that was cultivated within their own menua (Daleh) and not outside is still their NCR land. This is our stand and the Court has confirmed this based on Common Law practices.

2. Contradictory to the above understanding is what the authority (some confused and ballless YBs) is trying to portray to our poor landowners in the longhouses. I heard them saying this and seen with my own eyes. They normally say to the kampung folks that ‘your NCR is only before 1.1.1958′ and the land or farms you cultivated after 1.1.1958 are ‘temuda land’ because ”itu perintah punya’. Mind you during the reign of Sultan Brunei and even James Brookes’ time in the early days……A longhouse territory is considered as equal as a LITTLE COUNTRY on its own with its own laws. Their RAJAH is the headman. He has the absolute authority.

3. So don’t get confused by these people. So as long as you stay put within your own longhouse’s territory you have NCR land regardless it was cultivated before or after 1.1.1958. So friends rise up and defend your rights over your own ADAT land.
